[ID 67] JUDICIAL REORGANIZATION IN AGRIBUSINESS ACTIVITIES

INTRODUCTION: The object of study of this work is the use and application of the Judicial Reorganization procedure in agribusiness economic activities.
OBJECTIVE: To analyze the application of the Judicial Reorganization Law for the Brazilian agribusiness sector; to know Law 11101/2005; to identify the requirements to be fulfilled to use the protection of the Judicial Reorganization Law in the agribusiness sector; to verify if the rural producer, who To analyze the application of the Judicial Reorganization Law for the Brazilian agribusiness sector; to know Law 11101/2005; to identify the requirements to be fulfilled to use the protection of the Judicial Reorganization Law in the agribusiness sector; to verify if the rural producer, who is an individual and, therefore, without commercial constitution for the minimum legal period, can make use of the Judicial Reorganization Law.
METHODS: Bibliographical research, with the hypothetical-deductive analysis method, scientific articles, legislation, materials from indexed periodicals and jurisprudence.

What is now required is the constitution of the company as a legal entity and the minimum registration time at the commercial registry of two years or the behavior as a company for the same period.
CONCLUSION: The current legislation has put an end to the existence of two distinct lines of defense in relation to Judicial Reorganization for individual rural producers. It is believed that due to the importance of the matter, the Courts will continue to be called upon to decide on this matter, until a jurisprudence is formed.
